September 15, (THEWILL) – The Supreme Court has dismissed the appeal challenging the election of Peter Mbah of the Peoples Democratic Party (PDP) as the winner of the March 18 gubernatorial election in Enugu State.
The All Progressives Congress (APC) and its governorship candidate in the Enugu guber poll, Uche Nnaji, had approached the apex court seeking to void the election of Peter Mbah.
The appeal was filed after the Court of Appeal in Enugu dismissed Nnaji’s case against Mbah in July.
According to the appellants, Mbah was not qualified to contest the March 18 gubernatorial election in Enugu State. The joint appeal consequently prayed the court to void all the votes polled by Governor Peter Mbah.
But in a ruling on Friday, by a five-member panel of Justices, the apex court held that Nnaji and his party filed an invalid brief of argument, which rendered their appeal incompetent.
Justice Tijani Abubakar, who read the lead judgment, also noted that Nnaji failed to explain why the invalid process they filed should be relied upon to invalidate Governor Mbah’s election victory.
