November 24, (THEWILL) – Former Deputy Senate President and candidate of the All Progressives Congress (APC), in the 2023 gubernatorial election in Delta state, Senator Ovie Omo-Agege, as well as his counterparts in the Social Democratic Party (SDP) and Labour Party (LP), have lost the Court of Appeal case challenging the victory of Governor Sheriff Oborevwori in the March 18 poll.

THEWILL reports that a three-member panel of the Court of Appeal in Lagos, on Friday, dismissed the three appeals filed before it for lack of merit.

The Delta State Governorship Election Petition Tribunal sitting in Asaba, led by Justice C.H. Ahuchaogu, on Friday, September 29, upheld Oborevwori’s election.

Ruling on the three petitions filed by Omo-Agege, candidate of the Social Democratic Party (SDP), Olorogun Kenneth Gbagi and the Labour Party Governorship candidate, Kennedy Pela, the tribunal, amongst others, held that the petitioners failed to prove their allegations of non-compliance with the electoral act.

Not satisfied by the tribunal, Omo-Agege, Gbagi and Pela approached the Court of Appeal on the matter.

The three-member panel of the Appellate Court presided over by Justice Hamma Barka had on Monday, November 13, 2023, reserved judgement in three separate appeals filed challenging the election of Sheriff Oborevwori as the governor of Delta State.

Ruling on the matter on Friday, the Appeal Court affirmed the verdict of the tribunal which upheld Oborevwori as the lawful winner of the March 18 governorship election in Delta.

The court dismissed the appeal of Ovie Omo-Agege and others against Oborevwori for lacking in merit.

The Independent National Electoral Commission (INEC) had declared Oborevwori of the PDP winner of the gubernatorial election in Delta State after he won 21 out of the 25 Local Government Areas in the state with 360,234 votes to beat his main challenger, Omo-Agege of the APC, who scored 240,229 votes.
