August 28, (THEWILL) – The leadership crisis rocking the opposition People’s Democratic Party (PDP) took a dramatic turn late Friday night as another High Court sitting in Cross River State restrained Prince Uche Secondus from returning to his seat as National Chairman.
The case was filed by Enang Kanum Wani.
THEWILL had reported that Justice Nusirat. I. Umar, a vacation Judge of the Kebbi State High court on Thursday restored Uche Secondus as the National Chairman, barely three days after a Rivers State High Court issued an ex parte order suspending him from office on Monday.
Granting an interim order in the suit No HC/240/2021, the court restrained him from assuming the office of National Chairman of the 2nd Defendant (PDP), while seeking re-election to the office of the National Chairman of the 2nd Defendant, pending the hearing and determination of the motion on notice.
In the case, Secondus is registered as the First Defendant, while PDP is the Second Defendant.
In the order signed by the Registrar, Ekei. E. Kooffreh, on Friday, the court further restrained Secondus from presiding over the National Executive Committee meeting, scheduled to hold on Saturday, 28th August 2021.
He cannot also preside over any subsequent meeting of the National Executive Committee and any meeting of any organ of PDP.
Furthermore, he cannot attend any such meetings or functions in the capacity of National Chairman of the party; or in any other manner or form forcefully attempting to gain entrance into any such meetings or into any premises of the PDP as the National Chairman of the party.
The order subsists until the hearing and determination of the motion on notice.
The ruling of the court read in part: “An order of interim injunction restraining the second defendant, its members, officers and agents from recognising the first defendant as its national chairman or from according him any of the powers, rights or privileges due to the holder of the office of the National Chairman of the 2nd Defendant pending the hearing and determination of the motion on notice.”
