Supreme Court Delivers First Ruling Against Atiku’s Appeal

SAN FRANCISCO, October 30, (THEWILL) – The Supreme Court has made a ruling on the appeal of the Peoples Democratic Party and its presidential candidate, Alhaji Atiku Abubakar against President Muhamamdu Buhari.

The seven-man panel in a short ruling, rejected the plea of Atiku and PDP to adopt all its interlocutory appeals alongside the main appeal against Buhari’s election victory stating that the main appeal shall be binding on all others.

Justice Tanko Muhammad, the Chief Justice of Nigeria (CJN), who leads the seven-man panel of the apex court, overruled Atiku and his party’s request that their seven interlocutory appeals should be heard after the main one must have been argued.

He stated that it would be unnecessary to hear the interlocutory appeals when a judgment on the main appeal marked would suffice.

The PDP and Atiku, had through Levi Uzoukwu, their lead counsel, asked the court to allow them adopt all their briefs both in the main appeal and seven other interlocutory appeals.

But ruling on the request after a short break, the court held that the main appeal covers the interlocutory appeals as well and therefore, only the main appeal should be adopted in court.

“All other appeals shall abide by judgement in SC/1211/19″ (which is the main appeal),” the panel said.
