Party Primaries: Bailiff Effects Substituted Service On APC, Alia

January 08, (THEWILL) – A substituted service was last Friday, served on the All Progressives Congress (APC) by the bailiff from the Court of Appeal, Makurdi Judicial Division, in a case instituted by one of the governorship aspirants in Benue State, Engr Barnabas Gemade.

This followed an order by the Judge of the court by posting the appeal summon at the gate of the APC secretariat in Makurdi, the state capital, on complaint by lawyers representing Gemade, who alleged that all efforts to serve APC and the second defendant, Revd Fr Hyacinth Alia, proved abortive.

Senator Gemade, who appealed the judgement of the Federal High Court, Makurdi Division, which dismissed his case, was challenging the purported governorship primary election of APC, which produced Fr Hyacinth Alia, as its candidate for the 2023 general election.

Counsel to Gemade, Barrister Tsevende, who was in company of the bailiff during the service, said the legal team assembled by Gemade were ready for the Appeal and hoped that justice would be done in their client’s favour.

It will be recalled that the Federal High court had dismissed Gemade’s case on grounds that it was filed out of time and the main case was not heard.
