September 28, (THEWILL) – The Supreme Court has fixed October 3, to deliver judgement in a an appeal brought before it by Senator Smart Adeyemi, challenging the conduct of the April 14 primary election of the All Progressives Congress (APC), for Kogi state governorship election.

Ahmed Ododo had emerged winner of the April 14th primary election of the APC for the November 11th gubernatorial election in Kogi State.

But Adeyemi is challenging the validity of the primary election on the grounds that relevant provisions of the Electoral Act and the guidelines of the APC were compromised during the primary election.

Adeyemi had lost his bid to have the primary election nullified at the Federal High Court, Abuja, and at the Court of Appeal.

Specifically, Adeyemi, who represented Kogi West senatorial district in the Senate, is claiming that the result released by APC in favour of Ododo was fraudulent and invalid, on the ground that the primary election was conducted in only 11 out of 239 wards in the state.

At Thursday’s hearing of the appeal, Adeyemi’s lawyer, Musibawu Adetumbi (SAN), after adopting his briefs, prayed the apex court to grant the reliefs sought by Adeyemi.
