Appeal Court Sacks Labour Party Reps Member Agbo, Orders Fresh Election

November 03, (THEWILL) – The Court of Appeal, Lagos Division, has sacked Denis Agbo, the Labour Party (LP) member representing Udenu/Igboeze North federal constituency of Enugu State in the National Assembly.

Delivering judgement on Friday, via Zoom, on the appeal filed by Oby Ajih, the All Progressives Congress (APC) candidate in the February 25 National Assembly election in the Udenu/Igboeze North Federal Constituency, a three-member panel of Justices, ordered the Independent National Electoral Commission (INEC), to conduct a fresh election for all parties involved within 90 days.

Ajih had approached the appellate court, challenging the ruling of the tribunal that upheld the election of Agbo.

The appellate had contended that the omission of his party logo in the EC8A form was flagrant abuse of the Electoral Act 2022.

The appeal court, in its judgement held that the non-inclusion of the logo of the APC in the result sheet (form EC8A) was against electoral laws, affirming the appeal as meritorious.
