September 08, (THEWILL) – A Spanish prosecutor has filed a complaint with the High Court against the suspended head of the country’s Football Federation, Luis Rubiales, over an alleged unsolicited kiss on the lips of women’s World Cup winner, Jenni Hermoso.
Prosecutor Marta Durantez Gil submitted the filing three days after Hermoso herself lodged a criminal complaint against Rubiales, as THEWILL reported. The prosecutor’s complaint describes how Rubiales allegedly kissed Hermoso on the mouth “without her consent” while holding her head with both hands after Spain’s victory over England in the women’s World Cup final in Sydney last month.
Rubiales has claimed the kiss was mutual and consensual despite calls for his resignation from players, officials and others. Durantez has also contacted Australian authorities to determine if the incident could be considered a sexual crime under Australian law. During her testimony, Hermoso said she and her family were pressured by Rubiales and his associates to say she approved of his actions, which the prosecutor says could constitute an additional charge of coercion.
The incident has provoked outrage in Spain over sexism, leading to Rubiales’ temporary suspension by FIFA after he refused to step down voluntarily. It also resulted in the sacking of the national team coach Jorge Vilda, an ally of Rubiales.
The prosecutor says Rubiales could face a sexual assault charge carrying 1-4 years in prison if Hermoso, who plays professionally in Mexico, were to file a formal complaint against him.
