November 27, (THEWILL) – The Court of Appeal, Abuja, has nullified the election of Hon. Yusuf Dahiru Liman, Speaker of the Kaduna State House of Assembly.
Liman is an All Progressives Congress (APC), lawmaker representing Makera constituency in the Kaduna State House of Assembly.
The Court, in a unanimous decision by Justice O. O Adejumo, Justice A. O. Oyetula and Justice P. An Obiora, Upheld the September 30 judgement of the Kaduna State Assembly Election Petition Tribunal, which nullified the election of Liman.
Solomon Nuhu Katuka of the Peoples Democratic Party (PDP), had approached the tribunal challenging the election of Liman as winner of the March 18 poll.
The tribunal had nullified the election of Liman and ordered a rerun in 42 polling units, including; 37 PUs in Makera ward, 2 PUs in Barnawa ward, 1 PU in Kakuri Gwari ward, 1 PU in Television ward, and 1 PU in Kakuri Hausa ward.
Dissatisfied with the judgement, Liman, and INEC, filed an appeal against the judgement of the Tribunal.
However, the appellate court in its judgment dismissed the appeal filed by the Speaker and INEC and ordered a rerun in 5 polling units, namely Barnawa Ward PU 005 and 009, Kakuri Gwari PU 006, Television Ward PU 022, and Kakuri Hausa Ward PU 045.
While Liman polled 17,470 votes and his PDP counterpart, 17,088 votes, the court held that the margin of lead, 382, was less than the number of PVCs collected in the 5 polling units. Consequently, it ordered a rerun poll in the polling units to determine the actual winner of the election.
