Court Adjourns El-Rufai’s Rights Enforcement Suit Against Kaduna Assembly

July 08, (THEWILL) – The Federal High Court, Kaduna, has adjourned until July 17, the hearing in a fundamental rights enforcement suit filed by former Governor Nasir El-Rufai against the State House of Assembly and its Attorney General.

El-Rufai had, on June 26, approached the Court in Kaduna to challenge the probe report of the Kaduna State House of Assembly, which indicted him for the alleged misappropriation of N432 billion during his eight years in administration.

THEWILL reports that the former governor is seeking the action of the court to declare the probe report “null and void,” having not been given the opportunity of fair hearing over the allegations leveled against him and his administration by the committee.

At the commencement of the hearing of the case on Monday, the counsel to the first respondent, the Kaduna State House of Assembly, Sani Katu (SAN), informed the court that they are in the process of filing a notice of preliminary objection, challenging the court’s jurisdiction to hear the case.

The counsel requested an extension of time to enable them to file all their applications on the case.

While the lawyer of the applicant, Sule Umoru, did not oppose the application for an extension of time, the presiding judge, Justice R.M. Aikawa, adjourned the case to July 17, 2024, to enable the respondents to file all their applications, including the substantive application.
