Illegal Detention: Benue Court Orders Army, Others To Pay Man N50m

November 17, (THEWILL) – A federal high court, sitting in Makurdi, has ordered the Nigerian Army and four other officers to jointly pay over N50 million to one Moses Neva of Katsina-Ala local government area, Benue state, over unlawful detention and aggravated damages.

Delivering judgement in a suit filed by Barrister Vincent Gwar, who is Counsel to the plaintiff, Mr Neva, the presiding judge, Justice Abdul Dogo, also ordered the Army authorities to immediately release the plaintiff from illegal detention and tender an apology to him, which should be published in a local newspaper in Benue state.

The plaintiff, through his Counsel, told the court that sometime in 2019, the Army officials in the name of peacekeeping arrested Mr Neva, who has been in their detention without an arrangement in a court of law.

The plaintiff in a relief motion also asked the Court to order the defendants to unconditionally release him, as well as award damages of N50 million to him.

Justice Dogo in his judgement stated that the plaintiff has proved his case of unlawful detention beyond all reasonable doubt to warrant judgement in his favour.
