BEVERLY HILLS, August 22, (THEWILL) – Former Chairman of the Peoples Democratic Party, PDP, in Delta State and Senator representing Delta North, Sen. Peter Nwaoboshi has been dragged to an Asaba High Court for blatant defiance to a judicial injunction granted by Justice F Azinge of the Delta State High Court sitting in Asaba.
The order arose from the ownership tussle of a property between DavNotch and the lawmaker (Nwaoboshi) in which all parties were restrained from accessing the parcel of land pending the determination of the substantive suit.
According to Davnotch’s counsel, Sola Rhiogbere, his client had instituted a case of trespass, vid suit No A/104/2016, accusing Senator Nwaoboshi of trespassing on his land, a claim which he denied and shunned adherence to the judicial injunction on the disputed property.
Continuing, the counsel said; “sequel to the development Form 48: notice of consequences of disobedience of court order was issued against the Senator but surprisingly, the Federal lawmaker still defied the order and was subsequently served with Form 49: notice to show cause why order of commital should not be made against you(Senator Nwaoboshi ).”
This development, Rhiogbere revealed, was preceded by his petitioning the Delta State Commissioner of Police, Mr. Zane Ibrahim alleging that in May this year, some persons believed to be agents of Chief Nwaoboshi, forcefully broke into the company’s land measuring 4019.440 square meters and began construction on the land.
He further averred that the ownership of the land is incontestable as available authenticated documents show that the Davnotch Enterprises owns the land situated at plot 37, Core Area, Central Spine, Phase IV, Asaba. This is covered by Certificate of Occupancy, No.DTSR 14767 issued in 2010, approved by the then State Governor, signed by then Commissioner for Lands, Raymos Guanah,on behalf of the governor. It wasregistered as No. 47 on page 47 involume Co 186 of the office of the Lands Registry in Asaba with relevant details of payment for the land.
Independent investigation shows that the same parcel of land which is being claimed by Chief Nwaoboshi was, however, not substantiated by documented evidence; rather, a close associate of Senator Nwaoboshi responded that the said land was allocated to the company in 2003 during the then Ibori administration without requisite documents.
Hearing in the case resumes on October 12, 2016.
