September 20, (THEWILL) – A nursing mother, Miss Nguseer Nyitar, who is standing trial before a High Court in Makurdi for allegedly killing her one-and-a-half-year-old child is to remain in prison custody.

When the case came up, the presiding Judge, Justice Theresa Igyoche, denied the bail application brought by her Counsel.

Counsel for the defendant, Barr. Antaav Kume, argued for bail before the court, submitting that the accused person had birthed the child while in custody which requires urgent care.

He further argued that the presence of the infant with her mother in such a harsh environment constitutes exceptional circumstances warranting bail despite the serious nature of the charges against her.

Prosecuting witness, however, opposed the arguments of the Counsel, pointing out that the accused person in her confessional statement regarding the alleged murder of her older child was clear.

In her ruling, Justice Igyoche therefore, ordered that custody of the newborn baby be transferred to her father or another relative of the defendant for proper care, while she remains in prison custody for trial.
